Nevada mail ballots can be counted 3 days after election, court rules

LAS VEGAS, Nev. (FOX5) - The Nevada Supreme Court has ruled that mail-in-ballots can be counted three days after Election Day.

In May, the Republican National Convention filed a lawsuit accusing the Nevada Secretary of State’s Office of violating federal election laws. The RNC argued that ballots counted after Election Day undermined election integrity.

“Republican voters vote by mail at a much lower percentage than Democratic voters. And thus, counting allegedly invalid mail ballots received after election day would benefit Democratic candidates at the expense of Republican candidates,” the lawsuit read.

The Supreme Court found that the RNC failed to provide a legal basis for their lawsuit and did not provide sufficient evidence. The three-judge panel highlighted that, following the 2024 primaries, only 24 mail ballots were received without postmarks.

The lawsuit is not expected to impact Election Day on Nov. 5.
